Opinion document: Legal definition of National Security

The legal concept of national interest is based on current legal thinking according to which there is a natural right of the so called nation states to maintain their own safety and that of its citizens. While international practice has not set the specific content of the notion of national security, it is possible to define it, as it’s the case, based on a given bilateral or multilateral treaty (and based on some law cases of the International Court of Justice and the European Court of Human Rights, among other international institutions), in what are known as “national security clauses” of these treaties (or international agreements) deriving from all these considerations different aspects of the national security and defense strategies.
