Study of the legal framework on terrorism with biological weapons: a systemic view (DIEEEM14-2016)

In our days exists a broad juridical framework when it comes to the fight against terrorism. The group of norms was originated in different fields, such as, United Nations, European Union, etc. nevertheless, there is little attention paid to the use of weapons of mass destruction, between them biological weapons, by non-state actors.

Likewise, there are some instruments which look for limiting and/or eliminating weapons of mass destruction proliferation devoted from the beginning to fight this activity from the State point of view, broadening its scope during the last few years to non-state actors.

A first analysis of the international framework currently in force shows the existence of several legal vacuums that could be abused by terrorist to develop and use biological weapons, as well as by organized crime in close cooperation with them.

This article will examine and analyze the problem of terrorism with biological weapons (as weapon of mass destruction) taking into account the conditioning aspects of the current legal framework, from a systemic perspective, meaning, considering this problematic the prominent aspects and the relationships existing between each of them and make proposals to the vacant areas.
