Solution of controversies in the law of the sea (DIEEEM09-2018)

The Convention of United Nations on the Law of the Sea regulate in its part XV the solution of controversies in the law of the sea. This Convention contemplates diplomatic means of resolution of conflicts and legal means. This work examines the different diplomatic means of solution of controversies, with its advantages of celerity and immediacy, and legal means. Among the legal means is the international Tribunal of the Law of the Sea, based in Hamburg, the International Court of Justice, the arbitral tribunal and arbitration. International arbitration is the most used means of conflict resolution. The Hamburg Court has been in operation for 20 years and shares jurisdiction with the International Court of Justice in The Hague, but the passage of time will show its importance, due to its greater efficiency and specialization.
